You agree not to do any of the following actions while using the Group SMS Service.
- Harass, "stalk", threaten, embarrass or cause distress or discomfort upon another user or other individual or entity or in group;
- Any Content in SMS that Webtoofani considers to be unlawful, harmful, threatening, abusive, harassing, defamatory,
- SMS that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit functionality of any computer software or hardware or telecommunications equipment;
- SMS that infringes any patent, trademark, trade secret, copyright, or other proprietary rights ("Rights") of any party;
- Cause any screen in the Services to "scroll" faster than other users are able to type to it or any action to a similar disruptive effect;
- Impersonate in the Services any person, including but not limited to, Webtoofani official, forum leader, guide or host;
- State or imply that Content you post or transmit through the Services is created or endorsed by Webtoofani, nor design it in such a way to imply such creation or endorsement;
- Disrupt the normal flow of dialogue within the Services or otherwise act in a manner that negatively affects other participants;
- Forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted via the Services;
- Collect or store personal data about other users;
- Intentionally or unintentionally violate any applicable local, state, national or international law, including but not limited to any regulations having the force of law while using or accessing the Services or in connection with your use of the Services in any manner;
- Post or transmit any unsolicited advertising, promotional materials, or any other forms of solicitation in the Services.
- Provide or send any content which may be harmful or detrimental to Webtoofani or its business associates, or which violates any restriction or policy established by Webtoofani or its business associates.
- In addition, you understand and acknowledge that differing countries, societies and governments may hold their citizens, companies and visitors to a different standard of conduct and speech (legal, ethical, moral and/or religious), and in this regard your Services may be terminated if they offend the conduct and speech standards of the country they are in or are transmitting in to. Considerations include:
- The sensibilities of the recipient of the transmissions whether they hold a difference religious or ethical viewpoint, are of a different race or heritage, have a mental disorder or handicap, or any other person having special circumstances;
- Transmissions to or aimed at an audience of children (persons under the age of 18) that include references to sexual practices and/or containing inappropriate or offensive language; and
- Content which promotes or incites terrorism, the misuse of weapons, or encourages or incites a person to commit a criminal offense.
You, the User of this service, understand that the service allows for you to be able to send messages to people in your group. You also understand that the intent of this service is to communicate only with people you know and not with whom you do not know and those who would not be interested in receiving messages from you.
- You, the User of this service, confirm that you have read the provisions of the NDNC registry of TRAI and understand that the essence of this registry is to reduce or take away the incidence of SPAM for mobile Users. (For more details on NDNC, visit http://ndncregistry.gov.in/ndncregistry/index.jsp)
- You, the User of this service, confirm that the mobile phone numbers to whom messages will be sent using this service are authentic & belong to people you have personal, professional or business relationships with. You further confirm that you have not included in the list any number of any person(s) who is not known to you.
- You, the User of this service, confirm that you can provide, on request, an auditable acceptance or permission from all such people whom you intend to send SMS messages to using this service, to receive messages from you via Webtoofani iSMS.
- You, the User of this service, understand that in light of NDNC and the clauses laid out therein, sending of any unsolicited message could result in penalties being levied.
- You, the User of this service, agree to use this service judiciously and without violating privacy of the people concerned. You also agree to comply with all necessary laws as maybe applicable.
- You, the User of the service, agree to bear all responsibility for the messages sent to your group by using this service. You agree to indemnify Webtoofani against all complaints and claims arising out of violation of the NDNC provisions due to your acts.
- You, the User of the service, agree to follow all laws of the land and respect and abide by all directives, guidelines and circulars issued by TRAI, as maybe applicable, from time to time.
- You, the User of the service, understand the message length of SMS messages, will be measured as follows Message length (upto) will be measured as per following chart .
i. 160-characters 1 messages
ii. 306-characters 2 messages
iii.459-characters 3 messages
iv. 612-characters 4 messages
v. 724-characters 5 messages
- You, the User of the service, understand and agree that it is your responsibility to consume the service within validity period offered to you, else the service will lapse after the validity period. In any case, maximum validity period of the service cannot exceed 1-year from the date of placing confirmed order against payment, after which the service will lapse.
- You, the User of the service, understand and agree that refund claims will not be entertained under any circumstances by Webtoofani.
- You, the User of the service, understand and agree that delivery reports of messages sent through the service are dependent on data provided to Webtoofani by mobile operators, which in turn is shared by Webtoofani with you. If the mobile operator does not provide data on delivery reports to Webtoofani, Webtoofani will not be able to pass on the same to you.
- You, the User of the service, agree to pay Webtoofani any amount that maybe payable for using the service, in excess to what you are entitled to as per order placed with Webtoofani.
- You, the User of the service, agree and understand that Interconnect charges, if applicable in future or in retrospect on any Indian or supporting overseas network, shall be charged extra and adjusted in the prepaid amount by Webtoofani.
- You, the User of the service, understand and agree that response to advertisements placed through the service cannot be guaranteed or assured by Webtoofani.
- Group SMS is a platform that uses SMS push pipes as obtained from SMS aggregators and mobile carriers. While Webtoofani makes all attempts and ensures that the SMS traffic is routed most efficiently and effectively it has no control over inherent network congestion and delays.
- Webtoofani will not share or publish your contact number with Third Party but Webtoofani and its group of companies will use your contact number for its own marketing purpose.
- You, the User of the service, understand and agree that only courts in Mumbai have jurisdiction over any and all matters pertaining to the service. Webtoofani reserves the right to terminate your account at any time without notice or liability, if Webtoofani determines that you have violated any of these terms and conditions. Webtoofani reserves the right to modify these policies at any time. By signing on the order booking form (as on the reverse side of this document) and / or by making or issuing payment for the service, you agree to all the terms and conditions above.
